19/05/10  ADR 65 Compliance for the Repair Sector
 

The Transport Operations Road Use Management Regulations (TORUMS) have recently been amended to include Chain of Responsibility type legislation relating to heavy vehicle speeding.  The changes target drivers, schedulers and consignors for their role in causing drivers to speed.  This has no real direct effect on our members yet, but is indicative of future direction for legislation.

CVIAQ is aware of planned future changes in this area and believes that repairers working on speed limiters will ultimately be pulled into the chain.  We anticipate that new offences relating to the operational capability and ADR compliance of vehicles will be included in the near future.

ADR 65 is due for review in the current work plan for the Federal Department of Transport and will be updated to better reflect the current technology being used.  Once this occurs it is expected that repairers will need to ensure that any operations carried out in their workshop are documented in a manner set out in the CVIAQ publication "Guidelines, ADR 65 Compliance for the Heavy Vehicle Industry" available at:

This document is no longer available in print so any member performing this work should ensure that they have a copy.

Members should review their workshop practices in relations to this issue and be particularly careful when requests are made to reset speed limiters.  If requested to reset a limiter as a result of a tyre size change be very cautious.  CVIAQ is aware of repairers who apply a Modification Plate detailing the change in tyre size when asked to reset speed limiters following a tyre change.  While there is no modification code for this operation, fitting the plate permanently records the reason for the repairer's adjustment.
