26/05/10  TMR look to review Repair Register Legislation
 

As an option offered by industry stakeholders at a meeting with the Department of Transport & Main Roads (TMR) and Queensland Police Service (QPS) in April 2010, TMR are looking to conduct a twelve month review of the repair register legislation.

The Repair Register legislation has existed for many years and requires repairers to record many details about the vehicles under repair in their workshop, eg:

s133 Transport Operations (Road Use Management) Act 1995

(a) the make, model, engine number, chassis number, registered number and colour of such motor vehicle; and

(b) the name and address of the person leaving such motor vehicle and of the owner thereof; and

(c) the date and time of receiving such motor vehicle at such garage or premises; and

(d) the nature of the repairs or painting, including colour of painting carried out; and

(e) such further particulars as may be prescribed

The legislation as it currently stands, penalises repairers with large fines and/or up to six months imprisonment for failing to keep a register or for inaccurate information recorded in their register.

Following the April meeting with industry stakeholders, TMR and QPS met further resulting in the Department announcing that they will engage in consultation over the next 12 months with Queensland Police Service and with internal stakeholders to come up with a solution to address industry's concerns.

It is a massive impost on the industry (and subsequently the community) to require detailed records to be kept of the most simple of mechanical repair operations. CVIAQ only supports “repairs” that alter or change a vehicle identifier, i.e. colour, engine number, registration number, chassis/VIN to be recorded in a “repair register”. CVIAQ members fully support the fight against vehicle related crime and will continue to assist the QPS where possible.

CVIAQ will continue to liaise with other industry associations and the Department to achieve a fair outcome for repairers and will keep members informed on all developments arising in this long standing issue.
